MyTrainero - Terms and Conditions for Private User 1.1.2012
1. General
MyTrainero.com is a web service owned by Trainero Ltd (FI21631653), Finland.
Service is focused to provide fitness exercise programmes and material to
customers. Free sign up is required to use MyTrainero.com. Each exercise
programme must be purchased separately. There are no recurring fees involved.
It is also required to accept these terms and conditions before sign up.
2. Sign Up
By signing up to free membership of MyTrainero.com the user acclaims to be
full-aged and understand that MyTrainero.com is not a medical organization. Any
of advices the MyTrainero.com offers should not be understood as a medical
advice or diagnosis. MyTrainero.com and Trainero Ltd takes no responsibility of
any damages that may occur by following MyTrainero.com's instructions. By
accepting these terms and conditions the user understand and accept the nature
of this service as a supporting and advicing tool for sports and fitness.
Trainero Ltd takes no responsibility of any misleading, incorrect, partial or
misinterpreted information that may be presented in the service and that may
have cause damage to user.
When signing up and during the use of the service the user is asked personal
details and preferences that the user acclaims to be valid. The membership is
personal and it is not allowed to transfer the membership to other person.
During the sign up the user select a private username and password the he/she
should be careful to not give or show to any 3rd party. The user is self
responsible the use of the username and password. If there is any doubt that
the password may hav gone to wrong hands, the user should immediatly inform
MyTrainero.com support. After the sign up the user will receive username and
password to his/her email.
The membership ends in following cases: a) the user announces the end of
membership to MyTrainero.com support and after receiving a response b) the user
does not log in to his/her account during one full year c) the user abuse the
service and MyTrainero.com quit the membership. In any of these cases all user
details, preferences and all exercise programmes (including all paid) will be
deleted from the database. In cases b) and c) The user will receive
notification email before the membership will end and therefore will have time
to react the situation.
As a part of the service, the MyTrainero.com may send emails about a) issues
related to service, for example updates, new features, notifications, offers
and discounts, etc b) marketing material from Trainero Ltd's partners. The user
has an option to enable or disable both these contact methods during the sign
up. The user also accepts that sending automated emails is part of the service
in some cases, particularly in 6 Months Trainin Packet and these emails can not
be disabled.
Trainero Ltd will not give users' information to 3rd party in any cases. All
possible marketing emails are sent from MyTrainero.com.
MyTrainero.com service is meant to non-commercial private use only unless
otherwise stated.
3. Use and Payment
A member can purchase exercise programmes by purchasing so called credits that
can be accumulated and stored for later use. Payment method is PayPal that
supports all major credit cards and also other type of payment methods.
The user must process the payment before getting credits. Credits are to
account immediatly after the payment and the service is ready to use.
4. Cancellation
A member can cancel his/her purchase within 14 days of payment if he/she has
not used the service. In this context the using the service means that the user
has created an exercise programme with purchased credits. This also applies to 6
Months Training Packet: if none of involved exercises are created within 14 days
from purchase, the member has right to cancel the purchase. Money are returned
to customer by using the PayPal cancellation process. Withdrawing funds back
from PayPal is considered to be under the terms and conditions of PayPal
service.
5. Immaterial Rights and Copyrights
The content, texts, images, layout and graphics are protected by international
immaterial and copyright laws. All content is owned by Trainero Ltd or
partially Trainero Ltd's partners.
The user can use the material the MyTrainero.com provides only to his/her
personal and private use. The user shall not copy any of the content. The user
shall not publish his private material to public in any means without a
permission from Trainero Ltd. The user still may present his private material
to his/her peers in demonstration purposes. The user shall not take any part of
the content and publish it to public. If there is situation according to
mentioned cases where the user must present his/her private material, the
source of the material should always be attached to material so that the viewer
has clear understanding where the material is originated.
6. Security
Internet environment and computer networks are never fully secure. Therefore
the user by accepting these terms and conditions assures that he/she understand
this issue andunderstand that even the Trainero Ltd implements all the best
practices to maintain data security in service software and in server there is
always a small possibility to security attacks and possible data loss.
7. MyTrainero.com Responsibility
MyTrainero.com service will be online every day and every hour with some
exceptions excluded. Trainero Ltd has a right to change the service, disable or
delete some parts of it, add new features and update the system. Trainero Ltd
also preserve the right to close the service due to necessary updates, system
administration operations or by other forced reason. Trainero Ltd does not
promise that the service functions without flaws but actively try to eliminate
and fix all found flaws.
8. Force Majeure
In the case of Force Majeure the Trainero Ltd will be released from every
responsibility. Situations that may cause Force Majeure are included but not
excluded, fire, earthquake, flood, explosion, strike, authorative actions, war,
network collapse or other reason that could not be anticipated beforehand and
that there is no reasonable proactive action that could have been facilitated
beforehand.
Trainero Ltd will announce the Force Majeure situation in the website
MyTrainero.com after the situation has occured, if it is possible to announce.

10. Rights Preserved
Trainero Ltd may in any time without any announcement to change these terms and
conditions. New Terms and Conditions are presented in the front page of the user
(right after login procedure). Changes will become valid by time that the
Trainero Ltd announces. The user accept changes by continuing the use of the
serive. Otherwise the user should stop using the service immediatly and cancel
the membership by following the rules stated in clause 4 of this document.

Client data maintaining for identification of user during log in, for using the
service, for sending support request, for payment, for statistics, for
advertising and for direct marketing that the user may disable as needed.
5. Register Content
Person name, address, phone number, email address, age, gender, profession,
homepages, personal health condition, username, password, login statistics and
using statistics.
6. Register Content Source
Data is gathered from the user during the sign up and during the use of
servive. Login statistics is gathered automatically when logging in. Using
statistics is gathered during using the service by registering user actions.
7. Register Content Publishing
Any of the register data is not published of given to 3rd party.
8. Data Security
Data is collected to database that is protected by passwords, firewalls and
other technical means. The operational software implements all the best
practices to protect the data. Database and backups are physically located in
locked and secured facilities and only Trainero Ltd's personels and server
administrators have access to database.
